‘Forged’ TC of students: HC dismisses plea seeking quashing of chargesheet

The Kerala High Court has dismissed a plea by the headmaster of Abdulla Kunju Memorial School, Kollam, seeking quashing of the chargesheet in a case related to the alleged forging of transfer certificates (TC) of students in 2002 to help increase the number of divisions in the school and to thus post more teachers.

There was also an alleged attempt to retain the names of students who had left the school, in its records. The Vigilance and Anti-Corruption Bureau had filed a chargesheet against the school’s then headmaster in charge, headmistress, and the manager under the Prevention of Corruption Act and the IPC, on detecting that 16 fake admissions were made using forged TCs and applications. The roll strength of the school was thus revised, three additional divisions secured, and teachers appointed. This caused a loss of ₹1.08 lakh to the government.

Dismissing the petition, a Bench of Justice A. Badharudeen said that since the prosecution records showed that the petitioner had committed the offence as alleged, the quashing of the crime could not be considered.
