The Kerala High Court has refused to entertain an anticipatory bail plea filed directly before it by a Kozhikode resident, citing that he ought to have approached the sessions court concerned.
Referring to the Supreme Court recently disapproving of the Kerala High Court entertaining bail pleas ‘bypassing’ sessions courts, a Bench of Justice K. Babu said that the petitioner in this case did not plead any exceptional circumstance that prevented him from approaching the sessions court concerned.
It cited a Supreme Court observation that the hierarchy of courts demands that no person seeking remedy under Section 482 of Bharatiya Nagarik Suraksha Sanhita should be allowed or encouraged to directly approach the High Court, although concurrent jurisdiction is conferred upon both sessions courts and High Courts. The High Court went on to dismiss his bail plea.
